1Acceptance of Terms

By creating an account, accessing, or using Dmeals.in, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Service. These Terms apply to all users, including free and paid subscribers.

2Description of Service

Dmeals.in provides a digital menu platform that includes:

Cloud-based menu management dashboard
QR code generation for menu access
Customer-facing digital menu pages
Menu analytics and reporting tools
Offer and promotion management system
Custom branding and theme options (paid plans)

Dmeals is NOT a food ordering, delivery, or payment processing platform. We do not facilitate transactions between restaurants and customers.

3Account Registration

To use our Service, you must:

•Be at least 18 years of age
•Provide accurate and complete registration information
•Maintain the security of your account credentials
•Notify us immediately of any unauthorized access

You are responsible for all activity under your account. One person/business may maintain one free account. Additional accounts require paid subscriptions.

4Your Obligations

You agree to:

•Provide accurate menu information including correct prices and food type labels
•Not use the Service for any unlawful purpose
•Not upload content that infringes on third-party intellectual property rights
•Comply with FSSAI guidelines for food labeling and allergen information
•Not attempt to reverse engineer, hack, or disrupt the Service
•Not resell, sublicense, or redistribute the Service

5Content Ownership

You retain full ownership of all menu content you upload: dish names, descriptions, prices, images, and offers.

By uploading content, you grant Dmeals a limited, non-exclusive license to host, display, and transmit your content solely for the purpose of providing the Service.

You represent that you have the right to upload all content and that it does not violate any third-party rights.

📌 Important: Upon account deletion, your menu content will be permanently deleted within 30 days unless you request an export.

6Payment & Billing

Free Plan: No payment required. Subject to usage limits (1 restaurant, 30 dishes).

Paid Plans: Billed monthly or annually as selected. Prices are in Indian Rupees (₹) and inclusive of applicable taxes.

Payment Methods: UPI, Credit/Debit Cards, Net Banking via Razorpay/Stripe.

Renewal: Auto-renewed at the end of each billing cycle unless cancelled before renewal date.

Failed Payments: If payment fails, we'll retry for 7 days. After that, your account downgrades to the Free plan. Your data is preserved for 90 days.

Price Changes: We may change prices with 30 days' advance notice. Existing subscribers are locked in at their current price for the current billing period.

7Intellectual Property

The Dmeals platform, including its design, code, logos, trademarks, and documentation, is the intellectual property of Dmeals Technologies Pvt. Ltd. and is protected by Indian and international intellectual property laws.

You may NOT:

•Copy, modify, or distribute our source code
•Use our trademarks, logos, or brand elements without written permission
•Create derivative works based on our platform
•Remove, alter, or hide any proprietary notices

8Prohibited Uses

🚫 Illegal Content

Using the menu to promote illegal activities, substances, or services

🚫 Misleading Prices

Displaying incorrect prices to deceive customers

🚫 Wrong Food Labels

Mislabeling non-veg items as veg (FSSAI violation)

🚫 Spam & Abuse

Using QR codes to redirect to spam or phishing pages

🚫 System Abuse

Excessive API calls, scraping, or DDoS-like behavior

🚫 Competitor Use

Competitors using our platform to replicate our service

Violation of these terms may result in immediate account suspension without refund.

9Limitation of Liability

To the maximum extent permitted by Indian law:

•Dmeals is provided "as is" without warranties of any kind, express or implied
•We shall not be liable for any indirect, incidental, special, or consequential damages
•Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
•We are not liable for losses due to internet outages, device issues, or third-party service failures
•We are not responsible for the accuracy of menu content uploaded by restaurant owners

10Termination

By You: You may cancel your account at any time from your dashboard settings. No lock-in period. Your data is preserved for 90 days after cancellation for reactivation.

By Us: We may suspend or terminate your account for: violation of these Terms, fraudulent activity, prolonged non-payment, or legal requirements. We'll provide advance notice except in cases of serious violation.

Effect of Termination: Upon termination, your QR codes will stop working, access to the dashboard will be revoked, and your data will be deleted after the 90-day retention period.

11Disclaimer

Dmeals provides a menu display platform only. We do not guarantee: uninterrupted service, fitness for any particular purpose, or that the Service will be error-free. We make no guarantees about the number of QR scans, menu views, or business outcomes from using our platform. Any testimonials or statistics on our website are for illustrative purposes and do not guarantee similar results.

12Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.

Arbitration: Before initiating legal proceedings, you agree to attempt resolution through arbitration as per the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Bangalore in English.
